Terms & Conditions

• Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
• Consumer: a natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.
• Day: calendar day.
• Durable medium: any means enabling the consumer or entrepreneur to store information addressed to them personally for future consultation and unchanged reproduction.
• Right of withdrawal: the consumer's option to cancel the distance contract within the cooling-off period.
• Model form: the withdrawal model form made available by the entrepreneur.
• Entrepreneur: the natural or legal person who offers products to consumers at a distance — in this case The Scents of Amsterdam B.V.
• Distance contract: a contract concluded between the entrepreneur and the consumer within a system organised for distance sales, using one or more means of distance communication exclusively.
• General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

1. These general terms and conditions apply to every offer of the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

2. Before the distance contract is concluded, the text of these terms is made available to the consumer. Where this is not reasonably possible, the entrepreneur will indicate how the terms may be consulted and that they will be sent free of charge upon request.

3. If the distance contract is concluded electronically, the text of these terms may be made available electronically in such a way that the consumer can easily store them on a durable medium.

4. If one or more provisions in these terms are at any time wholly or partially void or annulled, the remainder of the agreement and these terms remain in force, and the relevant provision will be replaced by mutual consultation by a provision that approximates the original as closely as possible.

5. Situations not covered by these terms shall be assessed in the spirit of these terms.

1. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.

2. The offer is without obligation. The entrepreneur is entitled to change and adapt the offer.

3. The offer contains a complete and accurate description of the products offered, sufficiently detailed to enable a proper assessment by the consumer. Images are a true representation of the products. Obvious mistakes or errors in the offer do not bind the entrepreneur.

4. All images and specifications are indicative and cannot give rise to compensation or termination of the agreement.

5. The entrepreneur cannot guarantee that the colours displayed correspond exactly to the real colours of the products.

6. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to acceptance: the price including taxes, any shipping costs, the method of payment, delivery and execution, the period within which the right of withdrawal may be exercised, and any applicable warranties.

1. The agreement is concluded at the moment the consumer accepts the offer and complies with the conditions set.

2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance electronically. As long as receipt of this acceptance has not been confirmed, the consumer may dissolve the agreement.

3. If the agreement is concluded electronically, the entrepreneur takes appropriate technical and organisational measures to secure the electronic transfer of data and ensures a secure web environment. Checkout and payment are processed by Shopify in a secure environment.

4. The entrepreneur may, within statutory limits, inform itself whether the consumer can meet his payment obligations. If, on the basis of this investigation, the entrepreneur has sound grounds not to enter into the agreement, it is entitled to refuse an order or attach special conditions to it, stating reasons.

5. The entrepreneur will send the following information with the product, in writing or in a way that can be stored by the consumer on a durable medium: the visiting address for complaints, the conditions and manner for exercising the right of withdrawal, information about warranties and after-sales service, and the requirements for terminating the agreement.

6. Every agreement is entered into under the suspensive condition of sufficient availability of the products in question.

1. When purchasing products, the consumer has the option to dissolve the agreement without giving reasons within 14 days. This cooling-off period commences on the day after receipt of the product by the consumer or a representative designated in advance.

2. During the cooling-off period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep it. If he exercises his right of withdrawal, he will return the product with all accessories supplied and — if reasonably possible — in the original condition and packaging.

3. To exercise the right of withdrawal, the consumer must inform the entrepreneur within 14 days of receipt, via email to contact@thescentsofamsterdam.com or by using the model withdrawal form. After this notification the product must be returned within a further 14 days. The consumer must prove timely return, for example by a proof of shipment.

4. If, after expiry of these periods, the consumer has not made known his wish to exercise the right of withdrawal or has not returned the product, the purchase is a fact.

1. If the consumer exercises his right of withdrawal, the costs of return shipment are borne by the consumer.

2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal. This is subject to the product having been received back by the entrepreneur or conclusive proof of complete return being provided. Refunds will be made using the same payment method as the original transaction, unless the consumer expressly consents to another method.

3. If the product is damaged due to careless handling by the consumer, the consumer is liable for any reduction in value of the product.

The right of withdrawal is excluded for products:

• that have been manufactured to the consumer's specifications;
• that are clearly personal in nature;
• that by their nature cannot be returned;
• that are not suitable for return for reasons of hygiene, if the seal has been broken after delivery — this applies in particular to opened fragrances.

This will always be clearly stated with the relevant product.

1. During the period of validity stated in the offer, the prices of the products offered will not be increased, except for price changes as a result of changes in VAT rates.

2. Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.

3. The prices stated in the offer of products include VAT.

4. All prices are subject to printing and typographical errors. No liability is accepted for the consequences thereof. In the event of such errors, the entrepreneur is not obliged to deliver the product at the incorrect price.

1. The entrepreneur warrants that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the statutory provisions and/or government regulations existing on the date the agreement is concluded.

2. A warranty provided by the entrepreneur, manufacturer or importer does not affect the statutory rights and claims the consumer may invoke under the agreement against the entrepreneur.

3. Any defects or incorrectly delivered products must be reported in writing to the entrepreneur within 2 months of delivery. Products must be returned in the original packaging and in new condition.

4. The warranty does not apply if the consumer has himself repaired or modified the products, has had them repaired or modified by third parties, if they have been exposed to abnormal conditions or have otherwise been treated carelessly or contrary to the instructions of the entrepreneur.

1. The entrepreneur will exercise the utmost care when receiving and executing orders for products.

2. The place of delivery is the address that the consumer has made known to the entrepreneur.

3. Accepted orders will be executed expeditiously, but no later than within 30 days, unless a longer delivery period has been agreed. If delivery is delayed or cannot be fulfilled in whole or in part, the consumer will be notified no later than 30 days after placing the order. The consumer then has the right to dissolve the agreement free of charge. The consumer is not entitled to any compensation.

4. All delivery times are indicative. The consumer cannot derive any rights from any stated times.

5. In the event of dissolution under paragraph 3, the entrepreneur will refund the amount paid by the consumer as soon as possible, but no later than within 14 days after dissolution.

6. The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a previously designated representative, unless expressly agreed otherwise.

1. Payment is made via the payment methods offered at checkout, which is processed by Shopify. Orders are only shipped after the payment has been received in full.

2. The consumer has the obligation to immediately report any inaccuracies in payment details provided.

3. In the event of non-payment by the consumer, the entrepreneur has the right, subject to statutory restrictions, to charge reasonable costs communicated to the consumer in advance.

1. The entrepreneur has a publicly known complaints procedure and handles complaints in accordance with it.

2. Complaints about the performance of the agreement must be submitted fully and clearly described to the entrepreneur within 2 months after the consumer has discovered the defects, by email to contact@thescentsofamsterdam.com.

3. Complaints submitted to the entrepreneur are answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed reply.

4. In case of complaints, a consumer should first contact the entrepreneur. The Scents of Amsterdam B.V. is a member of Stichting WebwinkelKeur. For complaints that cannot be resolved by mutual agreement, the consumer can contact Stichting WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. If no solution is reached, the consumer can have the dispute handled by the independent disputes committee appointed by Stichting WebwinkelKeur, whose decision is binding. Costs for submitting a dispute to this committee are borne by the consumer.

5. It is also possible to register complaints via the European ODR platform: ec.europa.eu/odr.

1. Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law, even if the consumer lives abroad.

2. The Vienna Sales Convention does not apply.

Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.
